Terms of Service

1. Acceptance of Terms
By accessing or using PostureCompass (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms. If you do not agree, do not use the Service.
2. Description of Service
PostureCompass is a cloud-based security configuration assessment platform that provides continuous posture monitoring, CIS benchmark mapping, drift detection, asset scoring, and guided remediation for IT infrastructure. The Service is provided on a subscription basis as described on our pricing page.
3. Account Registration
You must create an account to access the Service. You agree to provide accurate information and to keep your credentials confidential. You are responsible for all activity that occurs under your account. Notify us immediately at legal@posturecompass.com if you suspect unauthorized access.
4. Subscriptions & Billing
Subscriptions are billed per asset per month. Your subscription renews automatically unless cancelled before the renewal date. All fees are in USD and are non-refundable except as required by law. We reserve the right to change pricing with 30 days' notice. Volume discounts and enterprise contracts are governed by separate order forms.
5. Acceptable Use
You agree not to: (a) use the Service to attack, probe, or scan systems you do not own or have explicit written authorization to test; (b) reverse-engineer, decompile, or attempt to extract source code; (c) resell or sublicense the Service without our written consent; (d) upload malicious code or interfere with the integrity of the Service; or (e) violate any applicable law or regulation.
6. Data & Privacy
Your use of the Service is also governed by our Privacy Policy, incorporated herein by reference. You retain ownership of all data you submit to the Service. You grant Seclight Inc. a limited license to process that data solely to provide and improve the Service. We implement industry-standard security controls and do not sell your data to third parties.
7. Intellectual Property
Seclight Inc. retains all rights, title, and interest in the Service, including all software, algorithms, UI designs, and documentation. Nothing in these Terms transfers any IP rights to you. Feedback you provide may be used by us without obligation.
8. Disclaimer of Warranties
The Service is provided "as is" and "as available." To the maximum extent permitted by law, Seclight Inc. disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of vulnerabilities.
9. Limitation of Liability
To the fullest extent permitted by applicable law, Seclight Inc.'s total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the fees you paid in the twelve (12) months preceding the claim. In no event shall either party be liable for indirect, incidental, special, consequential, or punitive damages.
10. Termination
Either party may terminate the subscription at any time. Upon termination, your access to the Service ceases and we may delete your data after a 30-day grace period, except where retention is required by law. Sections 7–11 survive termination.
11. Governing Law
These Terms are governed by the laws of the Province of Quebec, Canada, without regard to conflict-of-law principles. Any dispute shall be resolved in the courts of Montreal, Quebec, and both parties consent to that jurisdiction.
12. Changes to Terms
We may update these Terms from time to time. We will notify you by email or in-app notice at least 14 days before material changes take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
